PhotoBotanic is a rights-managed Stock photo agency. All rights are owned and copyrighted by PhotoBotanic and are licensed on a fee per usage. Fees depend on the type of use and must be agreed upon before publication.

Any photo that is published without written agreement from PhotoBotanic is subject to a minimum $1000 fee in addition to legal fees commensurate with recovery of rights lost to infringement.

Clients may download and use photographs for personal use, mock-ups and layout purposes without charge so long as the copyright notice embedded in the file accompanies such use. Once photographs are submitted for publication they are bound by Copyright law and PhotoBotanic’s Agreement, which will define the rights granted, uses permitted, and payment terms. Each Agreement is specific to each submission and applies to one-time use unless otherwise amended. Clients must consent to this Agreement before we send film.

Agreement

The Submissions Agreement will define specific terms that will come from a mutual disclosure of rights needed and rights available.

This General Agreement defines licensing and certain other terms that apply to all photographs regardless of fees or usage. By using our services and unless otherwise amended in writing all clients must agree to these terms.
